Terms of Service

Article 1 — Platform Publisher

The FlyMates Platform is published by FlyMates. For any question relating to these ToS, you may contact the publisher at: legal@flymates.app.

Article 2 — Purpose and Description of the Service

FlyMates is a mobile application enabling passengers on the same flight to connect with each other, exchange messages via a dedicated instant messaging service for the flight, and share information in a social and friendly environment.

The Platform is neither an air transport service nor a ticket booking tool. It does not replace the official services of airlines or airports in any way.

Article 3 — Conditions of Access

3.1 Minimum age

Access to the Platform is reserved for natural persons aged at least 16 years old. Below this age, registration is strictly prohibited. By creating an account, the user declares on their honour that they are at least 16 years old.

3.2 Account creation

Access to the Platform's features requires the creation of a personal account. The user undertakes to provide accurate, complete and up-to-date information at registration and to keep it up to date. Each user may only have one account.

3.3 Account security

The user is solely responsible for the confidentiality of their login credentials and any activity carried out from their account. Any unauthorised use must be immediately reported to FlyMates.

Article 4 — Use of the Platform

4.1 Permitted behaviour

• Use the Platform for personal, non-commercial purposes.
• Interact with other passengers in a respectful and friendly manner.
• Share truthful information relating to your flight.
• Report any inappropriate content using the available moderation tools.

4.2 Prohibited behaviour

The user is strictly prohibited from:

• Publishing any unlawful, defamatory, obscene, hateful, threatening content, or content that infringes the privacy of others.
• Impersonating another person or assuming a third party's identity.
• Using the Platform for commercial solicitation, advertising or unsolicited prospecting (spam).
• Attempting to gain unauthorised access to the computer systems of FlyMates or third parties.
• Collecting or extracting data from other users without their consent.
• Introducing viruses, Trojan horses or any other malicious code.
• Circumventing the Platform's security or authentication mechanisms.
• Using the Platform for harassment, intimidation or discrimination.

Article 5 — User Content

The user is solely responsible for the content they publish on the Platform (messages, profile pictures, personal information). By publishing content, the user grants FlyMates a non-exclusive, worldwide, royalty-free licence to host, store and display such content strictly within the framework of operating the service.

FlyMates reserves the right to remove any content contrary to these ToS, applicable law or public morality, without notice or compensation. FlyMates does not exercise prior and systematic moderation of published content.

Article 6 — Intellectual Property

All elements comprising the Platform (name, logo, graphic charter, source code, architecture, texts, interfaces) are the exclusive property of FlyMates and are protected by intellectual property law. Any unauthorised reproduction, representation, modification or exploitation is strictly prohibited.

These ToS do not grant the user any ownership rights over the Platform, but only a personal and non-transferable right of access and use.

Article 7 — Service Availability

FlyMates endeavours to keep the Platform accessible 24/7. However, FlyMates does not guarantee uninterrupted service availability and reserves the right to suspend access to the Platform, without notice, particularly for maintenance, updates or force majeure.

FlyMates shall not be held liable for service interruptions and their potential consequences.

Article 8 — Limitation of Liability

FlyMates is a connection service provider and is not a party to exchanges between users. FlyMates shall under no circumstances be held liable for:

• The content of messages exchanged between users.
• Relationships, meetings or interactions between users outside the Platform.
• Inaccuracies in flight information provided by users.
• Any indirect, immaterial or consequential damage resulting from use or inability to use the Platform.
• Malfunctions related to third parties (telecommunications operators, airlines, app stores).

Article 9 — Account Suspension and Termination

The user may delete their account at any time from the application settings. Such deletion results in the immediate termination of these ToS and the permanent deletion of personal data in accordance with the Privacy Policy.

FlyMates reserves the right to suspend or delete, without notice or compensation, the account of any user who violates these ToS, applicable law, or whose behaviour is detrimental to other users or the Platform's reputation.

Article 10 — Amendments to the ToS

FlyMates reserves the right to modify these ToS at any time. Users will be informed of any material change by in-app notification or email, at least thirty (30) days before the new version takes effect. Continued use of the Platform after that date constitutes acceptance of the new ToS.

Article 11 — Governing Law and Jurisdiction

These ToS are governed by French law. In the event of a dispute relating to their interpretation, validity or performance, the parties will endeavour to find an amicable solution. Failing an amicable agreement, the competent French courts shall have sole jurisdiction, subject to mandatory provisions protecting consumers residing in the European Union.

Article 12 — Miscellaneous Provisions

If one or more clauses of these ToS are declared null or unenforceable under applicable law or regulation, or following a final court decision, the other clauses shall remain in full force and effect.

The failure of FlyMates to invoke a clause of these ToS shall not be interpreted as a waiver of the right to invoke that clause at a later date.
